Brandfolder allows Meals on Wheels America (the “Association”) to distribute and manage brand assets through a cloud-based platform. The Association’s brands are a valuable asset that distinguish the Association from other organizations and signify to the public and member organizations the importance of meals on wheels services. To protect these assets it is important to adhere to the following terms of use:
1. Brandfolder Content. The Marketing & Communications Department is responsible for the upload and maintenance of the Association’s brand assets in Brandfolder. Individual users will not upload new or alter existing materials within Brandfolder absent the express prior authorization from the Marketing & Communications Department.
2. Branding. Use of any content in Brandfolder must conform to the Association’s Brand Guidelines.
3. Content Permission Verification. While some brand assets within Brandfolder will consist of trademarked or copyrighted materials held by the Association, other types of brand assets, such as videos and photographs depicting individuals, may have associated permissions for use of the asset. It is the responsibility of each individual utilizing a permission-based brand asset to verify use is permissible in the contemplated manner and is available for such use, or, in other words, the permission did not lapse or otherwise terminate prior to use.
4. Content Notes. Prior to using any asset in Brandfolder, and in addition to the above, it is the responsibility of each individual to review and comply with any notes or other descriptors associated with each asset. These notes are used for a variety of purposes and may impact use of the asset. For instance, information in a note may communicate that an individual depicted in an asset is deceased and the asset should not be used or that an asset expires after a certain date.
5. Content Use. Assets made available through Brandfolder are expressly limited to use for the benefit of the Association and furthering its purposes. Accordingly, assets must not be shared with members, sponsors, vendors or any other person or organization outside of the Association without prior written authorization and a fully executed license agreement.
